All employees are required to both read our Code of Business Conduct and Ethics and undergo training for the Code during Digital Realty’s annual attestation period. Our annual attestation covers training on our Insider Trading Policy, our FCPA and Anti-Corruption Compliance Policy, and anti-money laundering compliance. In our most recent Proxy meeting we passed a proposal that asks that the Board of Directors prepare a public report assessing the potential risks to the company associated with its use of concealment clauses in the context of harassment, discrimination and other unlawful acts. In 2020, Digital Realty formally launched its Diversity, Equity and Inclusion (DEI) Employee Leadership Council to assess the current state and opportunities for progress, formulate a cohesive strategy and ultimately lead Digital Realty’s global DEI effort. We have also launched five Employee Resource Groups (ERGs) including our Women's Leadership Forum, LGBTQIA+ ERG, Hispanic ERG, Black ERG and Veteran's ERG. We have several diversity-related trainings available through our Digital University, including unconscious bias trainings. We have also expanded FCPA trainings globally, including our recent acquisitions in Athens and Croatia.Environment

Overall Environment

In 2021, Digital Realty became the first data center operator to surpass one gigawatt of IT capacity certified in accordance with sustainable building standards, adding six new green building certifications in the U.S., U.K., and Japan. Digital Realty also achieved 64% renewable energy coverage globally in 2021, increasing renewable coverage 14% from the prior year as our energy use grew 11% within the same timeframe. We continue to maintain 100% renewable energy for our US colocation portfolio and European portfolios. We expanded our renewable portfolio, contracting for 28 MW of solar in Georgia, U.S. We now have 820 MW of new solar and wind under contract in the U.S., as well as 528 kW of solar installations in Europe and Africa. We made significant strides towards our 2030 global science-based carbon reduction target. We achieved a 48% reduction from baseline towards our 68% Scope 1 and 2 reduction target, and achieved an 11% reduction towards our 24% Scope 3 target. Our data center portfolio in France achieved carbon neutrality in 2020 and 2021 for Scope 1 and Scope 2 emissions and has committed to maintaining carbon neutrality through 2030. We received EPA ENERGY STAR certifications for an industry-leading 34 data centers, 67% of our US owned and managed portfolio. Our certified data centers saved 992,000 MWh compared to industry-average data centers. We received the ENERGY STAR Part of the Year Award for the third consecutive year in 2022, recognizing our achievements in 2021 and achieving the Sustained Excellence designation. We are the first and only data center company to receive the ENERGYSTAR Partner of the Year recognition, exemplifying our commitment to data center energy efficiency. As our global portfolio expands, we are focused on maintaining and expanding our efforts surrounding renewable energy, energy efficiency and water initiatives.Anti-corruption

Digital Realty has a zero-tolerance policy on corruption and bribery. We comply with the US Foreign Corrupt Practices Act, the UK Bribery Act, the UK Modern Slavery Act 2015, the German Criminal Code and other applicable laws. Our Foreign Corrupt Practices Act (FCPA) and Anti Corruption Compliance Policy is administered by the General Counsel. All employees are required to both read the policy and undergo training for the policy during Digital Realty’s annual attestation period.
